The Supreme Court of Justice has dismissed the suit seeking to disqualify Tinubu/Shettima from contesting the 2023 general elections based on double nomination by the vice Presidential candidate of the APC and former Borno State Governor Senator Kashim Shettima over double nomination.
The five member panel of the Supreme Court says the People's Democratic Party (PDP) lacked locus standi to institute the case because PDP is not a member of the APC.
The PDP had earlier claimed that Shettima has breached the provision of sections 29(1), 33, 35, and 84(1)(2) of the 2022 Electoral Act as amended.
The PDP argued that therefore, Shettima's nomination to contest the position of vice Presidential and a Senator at the same time contravened the law.
But in a swift response, the Supreme Court says the PDP lacked locus standi to institute the case ab initio and therefore dismissed the suit.
